1. About GetCaptions
GetCaptions is a service operated by bober (the legal business name; "bober", "we", "us", or "our") for automatically generating, editing, and exporting video subtitles and captions. By using our service at getcaptions.io (the "Service"), you ("you", "Customer") agree to these Terms & Conditions.
2. Accounts
You can use core features without an account. Some features (saving projects, paid plans) require an account, which you may create with an email address or via Google sign-in. You are responsible for keeping your account credentials secure and for all activity under your account.
3. Subscription & Billing
GetCaptions offers a free plan and paid subscription plans (Pro and Studio) billed monthly. The prices and limits of each plan are shown on our Pricing page. Payment is processed by Paddle.com Market Limited, which acts as the Merchant of Record for the transaction. By subscribing, you also agree to Paddle's Buyer Terms.
Paid subscriptions renew automatically each month on the anniversary of your subscription start date. You may cancel at any time from your account's billing page — cancellation takes effect at the end of the current billing period and your access continues until then.
4. Your Content
You retain ownership of the videos, audio, text, and subtitles you upload to or create with the Service ("Your Content"). You grant us a limited license to process, store, and transcode Your Content solely to provide the Service to you (for example, to generate and render subtitles). We do not claim ownership of Your Content and do not use it to train third-party models.
You represent that you have the necessary rights to Your Content and that it does not infringe the rights of others or violate any law.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal, fraudulent, or unauthorized purpose;
- Upload content you do not have the rights to, or that is unlawful or harmful;
- Transmit viruses, malware, or any malicious code;
- Attempt to gain unauthorized access to our systems or other users' data;
- Resell or sublicense the Service without our prior written consent;
- Abuse, overload, or attempt to circumvent the limits of the Service.
6. Data & Privacy
Our handling of your data is described in our Privacy Policy. Speech recognition runs on our own servers — your audio is not sent to a third-party transcription provider.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue features with reasonable notice where possible.
8. Refunds & Cancellation
Refund eligibility is governed by our Refund Policy.
9. Intellectual Property
All software, design, and content of the Service (excluding Your Content) are owned by bober or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service while your account is in good standing.
10. Limitation of Liability
To the maximum extent permitted by law, bober shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months prior to the event giving rise to the claim.
11. Termination
We may suspend or terminate your account for breach of these terms. You may stop using the Service at any time. Upon termination you will have 30 days to export your data, after which it may be deleted.
12. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before they take effect.
13. Governing Law
These terms are governed by the laws of Ukraine. Mandatory consumer-protection rights in your country of residence are not affected.
